How to get rid of AFU during martial law: all the reasons
Grounds for dismissal under Art. 26 ZU 2232-XII and amendments 3633-IX and 4063-IX. Updated: October 2026.
Release during martial law is possible in three tracks: unconditional right (disability, Military Medical Commission (MMC) finding of unfitness, capture, death of close relatives, age 60/65), conditional right (children, care of parents or spouse - with supporting documents) and a wider way (demobilization after the lifting of martial law). Grounds — Art. 26 h. 4 ZU 2232-XII. Details below.
Unconditional right (release at will)
- establishment of disability of any group (from 18.05.2024 — and III group, law 3633-IX);
- conclusion Military Medical Commission (MMC) about unfitness for service;
- stay in captivity;
- death (death) of close relatives: parents, children, wife/husband, full and half-brothers (4063-IX);
- reaching the age of 60 (65 for generals).
Conditional right (document must be confirmed)
- care for parents I–II gr. disability — if there are no other relatives of the 1st-2nd degree (act according to Resolution of the CMU 560);
- wife/husband with disability III gr. — only for special diagnoses;
- three or more children under 18 (without alimony debt for more than 3 months);
- independent upbringing of the child (court decision).
Common Path: Major Leave, Family Circumstances, Military Medical Commission (MMC), Rotations; it is demobilization after the abolition of martial law. The norm of 36 months was removed from draft law 10449.
